TTAB Grants SSJR’s Motion to Dismiss Claims in Trademark Opposition

The United States Trademark Trial and Appeal Broad (TTAB) granted SSJR’s Motion to Dismiss three of the four claims in a pending opposition for failure to state a claim. The Motion successfully asserted that the Notice of Opposition was insufficient under Rule 12(b)(6) of the Federal Rules of Civil Procedure to state a claim upon which relief could be based. As a result, Opposer’s claims of dilution and false association have been dismissed without leave to amend the complaint.
