SSJR Files Amicus Brief on Behalf of Connecticut Intellectual Property Law Association

SSJR filed an amicus brief at the Federal Circuit on behalf of the Connecticut Intellectual Property Law Association (“CIPLA”) in LIGHTING BALLAST CONTROL LLC v. PHILIPS ELECTRONICS NORTH AMERICA CORPORATION and UNIVERSAL LIGHTING TECHNOLOGIES, INC. CIPLA’s brief supports the request for a rehearing en banc to reconsider the current de novo standard of review for claim construction. The brief argues that deference to the trial court’s findings is appropriate where the court relies on extrinsic evidence and makes a threshold finding of fact when construing the asserted patent claims.
