David W. Aldrich
Mr. Aldrich has experience in all areas of patent, trademark, and copyright law, including prosecution, litigation, opinions, licensing, and counseling. His practice canvasses a wide array of technological areas, including pharmaceuticals, medical instruments, optics, analytical instruments, and mechanical devices.
Mr. Aldrich has significant experience in various types of patent litigation. Notably, he was involved in the seminal case Knorr-Bremse v. Dana and Haldex, an en banc appellate decision restoring the attorney-client privilege to patent law. Mr. Aldrich has represented both Plaintiffs and Defendants in numerous patent litigations, including multiple cases related to medical systems, such as the successful summary judgment rulings and appeal in Luma v. Stryker and Karl Storz Endoscopy-America. Mr. Aldrich also has signifigant experience with pharmaceutical patents, including the preparation of Paragraph IV notice letters and the litigation of Hatch-Waxman ANDA cases, which have involved generic versions of drugs such as Sporanox®, Zofran®, Abilify®, Actos®, Coreg®, Doryx®, MetroGel®, and Pulmicort Respules®.
Mr. Aldrich also has significant experience in the prosecution of patents in many different technologies. He has drafted over a hundred patent applications and has prosecuted hundreds of cases before the United States Patent and Trademark Office. He has also successfully argued multiple appeals before the Board of Patent Appeals and Interferences, such as Ex parte Koelzer (air system valve) and Ex parte Gross (electronic document proofing system).
