St. Onge IP Successfully Opposes Infringing Logo on Behalf of Rockport IP Holdings
St. Onge IP, representing the ROCKPORT shoe brand, successfully opposed a U.S. trademark application for an logo by Joshua Savoy on the grounds of similarity to Rockport’s logo. After a testimony period and trial briefs presented by Stephen P. McNamara and Samantha M. Gerold, the US Trademark Trials and Appeals Board ruled that Rockport had proved common law use of its logo on shoes which predated Savoy’s evidence of use and filing date of its logo, and further that the marks were similar and for similar goods, thus Rockport’s Opposition No. 91252440 was sustained, and Savoy’s counterclaim dismissed.
