St Onge IP wins motion to transfer Trademark case from Texas to Connecticut

St Onge IP attorneys Jonathan and Gene Winter recently won a motion to transfer a declaratory judgment action filed in Texas. The lawsuit was filed by a Texas company, Mr. Showers LLC, formerly known as Mr Shower Doors LLC. This company alleges it does not infringe the incontestable trademark rights of long time St Onge IP client Mr Shower Door Inc. The case was transferred because the Eastern District of Texas found personal jurisdiction lacking. The allegations to support jurisdiction involved only a Facebook takedown request and some letter and email correspondence, and these were deemed insufficient. St Onge IP looks forward to continuing to prosecute this Trademark and Cybersquatting case in the now proper forum of the District of Connecticut. The opinion is attached here.
